Majid Al Futtaim Properties LLC, a Dubai retail property developer, has been found guilty of reverse domain name hijacking (pdf) for a second time.

The company filed a case against Matajer.net. It has a shopping mall called Matajer Al Quoz that opened in 2011.

It admitted that the domain owner registered the domain before it had any trademark rights, but claims that it was renewed in bad faith and that the domain owner added Whois privacy in 2020. It argued, “Employing a privacy or proxy service by the Respondent after the Complainant has gained protection for its MATAJER trademark in 2011 confirms the Respondent’s bad faith registration of the disputed domain name.”

Wow.

The company was previously found guilty of reverse domain name hijacking in a case over CityCentre.com. It filed that case despite having previously lost a dispute against BeirutCityCenter.com in 2018.

You might think that the Complainant’s attorneys must know little about UDRP to file two reverse domain name hijacking cases on behalf of the same client. But the Complainant’s counsel in both cases was Talal Abu Ghazaleh Legal in Egypt. The firm’s founder is the chair of two non-profit organizations that formed The Arab Center for Dispute Resolution (ACDR), an ICANN-accredited UDRP forum.

Majid Al Futtaim Properties has pending cases against Matajer.ae, Matajer.com, Matajer.org, and Matajer.me. Matajer refers to the Arabic word “ماتجر “which means “shops” in Arabic.
