Pocketbook International appeals loss in pocketbook.com dispute
Company asks Court of Appeals for another opinion.
Ebook reader company Pocketbook International is appealing its loss in a lawsuit over pocketbook.com. The move comes immediately after the defendant in the case filed a claim for attorneys’ fees.
Pocketbook International filed a lawsuit against SiteTools, Inc., which owns pocketbook.com, in 2020 claiming trademark infringement and cybersquatting.
The ebook company has trademarks related to ebook readers and SiteTools has a trademark related to finance, which is an obvious use of the domain name.
Judge Dolly M. Gee granted a Motion for Summary Judgment in SiteTools’ favor earlier this year. It threw out nearly all of Pocketbook International’s claims, including trademark infringement and cybersquatting. Judge Gee noted there was unlikely to be any confusion between an ebook company and a financial one.
Now, immediately after Site tools filed its brief requesting attorneys’ fees, Pocketbook International is asking the Ninth Circuit Court of Appeals for help. In a filing with the District Court, it said it is appealing the decisions that are the crux of the matter.
