Judge finds with domain owner in latest ruling.
A judge has knocked down Pocketbook International’s attempt to salvage a lawsuit it filed against the owner of pocketbook.com.
The company, which makes ebook readers, filed a lawsuit against SiteTools, Inc., which owns pocketbook.com. It made a host of claims, including trademark infringement and cybersquatting.
Pocketbook International has trademarks related to ebook readers and SiteTools has a trademark related to finance, which is an obvious use of the domain name.
Judge Dolly M. Gee granted a Motion for Summary Judgment in SiteTools’ favor earlier this year. It threw out nearly all of Pocketbook International’s claims, including trademark infringement and cybersquatting. Judge Gee noted there was unlikely to be any confusion between an ebook company and a financial one.
All that remained were dueling motions to cancel each other’s trademarks.
Pocketbook International asked the court to reconsider. Judge Gee denied (pdf) that request today, and also dismissed the plaintiff’s claim to cancel SiteTools’ trademark. SiteTools agreed to drop its cancellation request against Pocketbook International’s trademark.
