Lamborghini wins Lambo.com as “NamePros username defense” fails

Domain owner cited his NamePros username as evidence that he’s commonly known as “Lambo”.

A World Intellectual Property Organization panel has ordered that the owner of lambo.com transfer the name to the upscale car maker. Lambo is a shortened term popularly used to refer to Lamborghini cars.

Automobili Lamborghini S.p.A. filed the case against Richard Blair, a domain investor who goes by the moniker Lambo. Part of Blair’s defense was that he is commonly known by the name, as evidenced by his username Lambo.com in posts on NamePros.

Blair took to NamePros to complain about the UDRP. He stated that he’s determined to defend the domain, although he didn’t hire a lawyer to defend the UDRP. On NamePros, he wrote:

Counter measures to humiliate such endeavours are afoot. Unlawful theft will be duly punished through legal and commensurate counter efforts including any coerced and submissive accomplices.

Panelists Antony Gold and Matthew Harris sided with the car maker and ordered the domain transferred. Part of their rationale was that Blair didn’t provide enough evidence of being known by the name.

Panelist Neil Anthony Brown disagreed in one of the lengthiest dissents I’ve seen in a UDRP. But with a 2-1 ruling, the domain name will be transferred unless Blair files a lawsuit to stop it.
